New approach to contract modifications at the sub-directorate of works of the road works directorate

By decision of the Directorate of Roads, a service under the Ministry of Public Works of Chile, a working team was formed to develop a procedure to standardize and streamline the administrative processing of amendments to its works contracts tendered in the form of unit prices executed by third parties, This is due to the fact that currently these procedures are not only late, cumbersome and have been recurrently observed by competent bodies in auditing and control processes, but they also prevent timely technical decisions from being made, thus harming and increasing the cost of the construction process, to the detriment of the taxpayer. This study presents the documentary compilation contrasted with the points of view of the internal teams and of the contractors and consultants, concluding that the deficiencies originate before the administrative process, with failures in the systematized management of the background, in the critical analysis and weighting of the problems, and in the absence of regulations that clarify responsibilities and contributions of the different actors.
As a solution, it is suggested that the service should have a management system for contracts, with emphasis on the processes of supervision, document compilation, problem analysis, and preparation and presentation of modification proposals, in addition to administrative processing. The implementation of these tools will change the approach to contract modifications from “standardized and agile processing of administrative resolutions” to a more adequate “permanent assurance of the integrity and consistency of the works under execution”.
